The legal assessment of a scooter accident depends heavily on your role: were you on the scooter yourself and did you collide with a car, or were you hit by a scooter as a cyclist or pedestrian? Legally, a scooter, moped, and light moped are motor vehicles. This has significant consequences for the question of liability, and this works both ways.
If you were riding your scooter and collided with a car or other motor vehicle, the question of fault is assessed under the unlawful act of Article 6:162 of the Dutch Civil Code (BW). Because you are driving a motor vehicle yourself, the additional protection of Article 185 of the Road Traffic Act (WVW), which cyclists and pedestrians do have, does not apply to you. The core question is therefore: who committed the traffic error? If the motorist failed to give you right of way or overlooked you, he is liable for your damages. Even in the case of shared liability, you can often still recover a significant portion.
The situation is completely reversed if you, as a cyclist or pedestrian, were hit by a scooter, moped, or light moped. In that case, you are the vulnerable road user, and the protection of Article 185 of the Road Traffic Act *does* apply. The driver of the scooter is then, in principle, liable for your damages, unless he proves force majeure, which in practice is virtually never achieved.
The well-known protection rules apply here as well: for cyclists and pedestrians aged 14 and older, the 50% rule (at least half of your damages reimbursed, often more via the equity adjustment), and for children under 14, the 100% rule (full compensation). As a cyclist or pedestrian hit, you are therefore in a very strong legal position, even against a scooter.
A common problem in scooter accidents is a modified scooter. If the other party was riding a modified vehicle, the insurer may attempt to refuse coverage. However, even then, you are not without protection as a victim: the mandatory WAM insurance protects injured parties, and if the scooter turns out to be uninsured or untraceable, you can turn to the Motor Vehicle Guarantee Fund (Waarborgfonds Motorverkeer). If you were the driver of the modified scooter yourself, this can have consequences for your own position; therefore, always have your situation assessed.
If you were a passenger on a scooter and sustained injuries, you are in a strong legal position. After all, a passenger is not to blame for the accident. You can claim damages from the liable party, and this could even be the driver of the scooter you were riding yourself if they made a mistake. So do not be discouraged by the thought that you were 'there yourself'; as a passenger, you are simply entitled to compensation for your personal injury.
