What happens after a motorcycle accident?

A motorcyclist has no bodywork, no crumple zone, and no airbag. Who is liable in a motorcycle accident?

Legally, a motorcycle is a motor vehicle, just like a car. This means that in the event of a collision between a motorcycle and another motorized vehicle, the question of fault is assessed under the unlawful act of Article 6:162 of the Dutch Civil Code (BW). The person who commits a traffic error and thereby causes damage is liable. The special protection of Article 185 of the Road Traffic Act (WVW), which applies to cyclists and pedestrians, does not apply to you as a motorcyclist, because you are driving a motor vehicle yourself.

The core question, therefore, is: who made the mistake? If the motorist hit you because they failed to yield the right of way or overlooked you, then they are liable for your damages. Even if you played a part yourself, you can often still recover a large portion of your damages; in that case, the extent to which each party's fault contributed to the accident is assessed.

Wrongly blamed? A reconstruction makes the difference

This is an important point of concern for motorcyclists. In practice, they are often wrongly blamed for (part of) the damage. A common assumption is that the motorcycle 'must have been speeding' or 'came speeding up suddenly'. Insurers like to use such footage to pay out less. Often, further investigation reveals that the motorist simply did not see the motorcyclist and failed to yield the right of way.

What should you do after a motorcycle accident?

Good to know about motorcycle accidents

Does the protection of Article 185 of the Road Traffic Act also apply to me as a motorcyclist?
No. That protection applies only to cyclists and pedestrians. A motorcycle is a motor vehicle, so the question of fault runs through the tort of Article 6:162 of the Dutch Civil Code: it revolves around who committed the traffic error.
The insurer says I was speeding. What now?
Don't let that be held against you so easily. Motorcyclists are often wrongly blamed. With an accident reconstruction, in which speeds, lines of sight, and skid marks are analyzed, an expert can demonstrate what actually happened.
The driver says he didn't see me. Is he liable then?
