What happens after a car accident?

A car collision can happen in many ways: a rear-end collision at a traffic light, a collision at an intersection, a side impact while merging, or an accident on the highway. In all these cases, you can sustain injuries as a driver or passenger. Sometimes these injuries are immediately visible, but often symptoms such as neck pain (whiplash), headaches, back pain, or concentration problems only manifest a day later.

Never underestimate your injuries, even if the damage to the car is minor. Neck injuries frequently occur, particularly in seemingly minor collisions. Therefore, always get a medical check-up and document your symptoms with your GP. This is not only beneficial for your recovery but also serves as important evidence for your records. Who is liable in a car accident?

The question of fault in a collision between cars is assessed under the unlawful act provisions of Article 6:162 of the Dutch Civil Code. The person who commits a traffic error and thereby causes damage is liable. Unlike a collision involving a cyclist or pedestrian, no additional protection applies between two motorized vehicles: here, everything revolves around the question of who made the mistake.

The rear-end collision: the rear driver is almost always liable

The most common type of collision is the rear-end collision. In such cases, a strong rule of thumb applies: the driver of the rear vehicle is, in principle, liable. You are always required to maintain sufficient distance to stop in time, even if the car in front brakes suddenly. If you were driving in front and were hit from behind, you are therefore in a very strong legal position.

The driver behind can rarely get away with this. Arguments such as 'he braked too abruptly' or 'I was blinded by the sun' are almost never accepted, because you have to adjust your driving behavior accordingly. Only in exceptional situations, for example if the car in front suddenly reversed without reason, might the situation be different.

Occupants are always protected

Were you a passenger in the car and did you get injured? Then you are in a very strong legal position. After all, an occupant is never at fault for the accident. You can claim damages from the liable driver, and that can even be the driver of the car you were in. Moreover, many cars have passenger accident insurance (SVI) for this purpose, which covers the damage to passengers and the driver regardless of who was at fault.

What if the blame seems shared?

Not every collision is black and white. Sometimes both drivers played a part, for example in an accident at an intersection where the right of way was unclear. In such cases, the extent to which each party's fault contributed to the accident and the resulting damage is assessed—known as the apportionment of causality. You will then receive compensation for a portion of your damages corresponding to the opposing party's share.

Subsequently, the equity adjustment can further revise that percentage in your favor, for example if the opposing party acted much more seriously or if your injury is very severe. Therefore, never let yourself be accused of fault too quickly; the opposing party's share is often higher than the insurer initially claims. An independent assessment of the circumstances often makes a significant difference in this regard.

Material damage includes everything that can be expressed in monetary terms:

  • Loss of income: if you are (partially) unable to work due to your injury.

  • Travel expenses: trips to the hospital, the physiotherapist, or the specialist.
  • Domestic help and informal care: help that family and friends provide for free also counts.

  • Loss of self-sufficiency: chores in and around the house that you can no longer do yourself.

What should you do after a car accident?

The steps you take immediately after the collision can be of great importance to your case file later on. Keep a cool head and consider the following points.

  • Take care of your health first: go to the GP or the hospital and always have your injury documented, even if in doubt.
  • Fill out the accident report form together: record the circumstances honestly and do not put pressure on a statement you do not stand behind.
  • Gather evidence: take photos of both vehicles, the damage, the road situation, and any skid marks.
  • Note down witnesses: ask for the name and phone number of people who saw it happen.
  • Keep all receipts: keep records of expenses such as travel, medication, and assistance.
  • Do not sign anything from the opposing party: do not enter into negotiations with the insurer yourself before an expert has reviewed the case.

Do I need an expert or a lawyer?
