What does a personal injury lawyer do?

A personal injury lawyer helps you obtain compensation for the damages you suffer after an accident for which another party is liable. This could include a traffic accident, a workplace accident, medical malpractice, or a fall caused by neglected maintenance. The extent of this damage is broader than many people think. It involves not only your medical expenses, but also loss of income, costs for domestic help, travel expenses, study delays, and home modifications. In addition, you are often entitled to pain and suffering: compensation for grief, pain, and the loss of enjoyment of life. A good advocate carefully and comprehensively maps out these items.

Lawyer, legal expert, or advocate — what is the difference?

The terms are often used interchangeably, but there are important differences. A personal injury lawyer is a legal professional who is registered with the Dutch Bar Association and has taken the lawyer's oath. Only a lawyer is permitted to litigate on your behalf in court in substantive proceedings.

A personal injury lawyer or advocate is a specialist who handles your case out of court: establishing liability, calculating damages, and negotiating with the insurer. In the vast majority of personal injury cases, litigation is not pursued at all; the case is resolved at the negotiating table. You do not need a lawyer for that, but you do need someone who has a thorough command of the profession.

What really matters is expertise and affiliation with recognized quality marks. We are affiliated with the NIVRE, the National Quality Mark for Personal Injury (NKL) , and De Letselschade Raad, and work in accordance with the Code of Conduct for the Handling of Personal Injury Claims (GBL). When do you really need a lawyer?

For the vast majority of personal injury cases, a lawyer is not necessary. An experienced representative can handle your case fully and successfully, as long as negotiations with the insurer are possible. Nevertheless, there are situations where the involvement of a lawyer is advisable or even required.

A lawyer is required as soon as the case has to go to court , for example in substantive proceedings. This applies if the insurer continues to dispute liability, if the parties remain fundamentally at odds regarding the amount of damages, or if there is complex causality and serious medical issues.

The partial dispute procedure exists between negotiation and a full-scale lawsuit . With this, you present one specific point of dispute to the judge—for example, liability or the interpretation of a medical report—without immediately litigating the entire case. This is often a quick and effective way to get stalled negotiations back on track. We engage a lawyer for the hearing of a partial dispute where necessary.

Who pays the personal injury lawyer?

This is perhaps the most important reassurance: in the event of personal injury for which another party is liable, you do not, in principle, have to bear the costs of legal assistance yourself. Pursuant to Article 6:96 of the Dutch Civil Code, the reasonable costs of legal assistance are borne by the liable party, i.e., their insurer.

In this regard, the so-called double reasonableness test applies : engaging legal assistance must be reasonable, and the amount of the costs must be reasonable. In a serious personal injury case, both conditions are almost always met. This means that our assistance is 100% free of charge for you as a victim . You keep your full compensation and will never receive a bill from us.

Please note: this applies to extrajudicial costs and, in principle, also to reasonable costs related to a partial dispute. In full proceedings on the merits, the cost allocation may differ, and court fees and orders for costs play a role. You always have free choice of lawyer

If you have legal expenses insurance, your insurer sometimes assigns their own lawyer. However, you do not have to agree to this. You have the right to choose your own lawyer: as soon as judicial or administrative proceedings are initiated, you may decide for yourself who assists you. This right stems from European regulations and has been confirmed by case law of the Court of Justice.

In practice, this means that you can engage a specialist of your choice during proceedings, even if you have legal assistance insurance. You are therefore not involuntarily linked to the lawyer that suits the insurer best. In cases of personal injury for which another party is liable, you often do not need legal assistance insurance at all, because the opposing party bears the costs pursuant to Article 6:96 of the Dutch Civil Code.

Please do take the limitation periods: in principle, a claim lapses after five years (Article 3:310 of the Dutch Civil Code), but a shorter period of three years applies against a WAM insurer.
