The legal basis is found in Article 6:106 of the Dutch Civil Code. It states that you are entitled to compensation, to be determined equitably, for damage other than pecuniary loss, including if you have sustained physical injury or your honor or good name has been harmed. In the case of personal injury, the former is most important: if you have suffered permanent or temporary injury caused by the actions of another, then compensation for pain and suffering comes into play.
Important to know: compensation for pain and suffering is separate from your other damages. Therefore, in addition to reimbursement of your medical expenses and loss of income, you can also claim compensation for pain and suffering. Pain and suffering compensation actually serves two functions. First, it is a form of recognition: society and the liable party acknowledge that you have been wronged and that you have suffered greatly as a result. Second, it is compensation that offers you the opportunity to do something pleasant or meaningful that थोड़ा eases the sense of loss. Of course, no monetary amount can make up for what has happened to you, but it can help you rebuild your life a little and give you the feeling that your suffering has been taken seriously.

This is often where the first disappointment comes: there is no fixed formula. Pain and suffering compensation is not calculated with a calculator, but determined based on equity. This means that a judge, and in practice usually the claims adjuster and the insurer together, assess what amount is fair and appropriate given all the circumstances of your case.

In practice, such a calculation proceeds in a few steps. First, we collect your medical data: the diagnosis, treatments, surgeries, and your doctors' prognosis. Next, we map out the impact of the injury on your daily life, work, and social activities. Subsequently, we look for comparable rulings in which judges have ruled on similar injuries. Based on this, we determine a substantiated range and a target amount. Only when this is established do we enter into discussions with the insurer. By carefully documenting everything in advance, we prevent you from accepting an offer that is too low.
Please note that compensation for pain and suffering is usually only definitively determined once the progress of your recovery is clear. In cases of permanent injury, one often waits until a so-called medical end state is reached: the point at which no further improvement or deterioration can reasonably be expected. Only then can the actual, permanent consequences be properly assessed. Sometimes an advance payment is possible to ensure you do not face financial difficulties in the interim.
A guideline amount from the guide is a starting point, not a final amount. Two people with the same bone fracture can experience very different consequences: one recovers completely, while the other retains permanent limitations or can never resume their work or hobby. It is precisely these personal consequences that make the difference. That is why it is so important that someone truly listens to your story. A calculation based solely on a diagnosis almost always falls short. What counts is how the injury impacts your life, and that differs from person to person.

The amount of compensation for pain and suffering is determined on a case-by-case basis. A number of factors carry significant weight:
All these factors combined determine where you fall within the range. It varies significantly by type of injury, and within each type, by individual. Therefore, a good calculation always begins with careful listening and thorough file review.
It is wise to keep track of things yourself during your recovery. Such a personal diary might sound unimportant, but it often provides valuable evidence later on of the impact on your life. These amounts provide an indication, not a guarantee. The highest compensation for pain and suffering awarded in the Netherlands is around 300,000 euros for very serious and life-disrupting injuries. What also stands out when looking at the ranges is that the difference between the lower and upper limits is large. In the case of a bone fracture, the difference between the minimum and maximum can easily amount to more than ten thousand euros. Exactly where you end up depends on the personal consequences we discussed earlier. That is why it is so important that your situation is fully and honestly assessed. If you underestimate the consequences, you will miss out on compensation to which you were entitled. An experienced claims handler knows exactly which arguments and rulings work in your favor.
Good news: compensation for pain and suffering is, in principle, tax-free. You do not have to pay income tax on the compensation received, because it is not income but compensation for suffering endured. So, you keep 100% of your compensation for pain and suffering.
There is, however, one point to consider. As soon as the amount is in your account, it is considered part of your assets. If your total assets exceed the exemption in Box 3 , it may count towards the capital yield tax in later years. The compensation for pain and suffering itself is therefore not taxed, but it can indirectly increase your Box 3 assets. For most people, this remains within the exemption, but for large amounts, it is wise to take this into account.
